Privacy Notice


Our commitment to Privacy: First Bermuda Securities has a policy of protecting the confidentiality and security of information we collect about institutional clients as well as non-clients. FBS will not share nonpublic information (“Information”) without a client’s consent, except for specific purposes described below.  This notice describes the Information FBS collects and the circumstances under which the Information may be shared. 

Why FBS Collects Information and How FBS Uses It:  FBS limits the collection and use of Information to the minimum FBS requires to provide superior service to its institutional clients and to meet recordkeeping requirements.

How FBS Gathers Information:  FBS obtains most of its required Information directly from its institutional client when it applies to use services offered by FBS.  FBS may verify this Information or get additional Information from reporting third parties, government or public sources. 

How FBS Protects Information:  FBS employees are required to protect the confidentiality of Information and to comply with the Firm’s established policies.  FBS employees may access Information only when there is an appropriate reason to do so such as to offer and administer the Firm’s products or services.  FBS also maintains physical, electronic and procedural safeguards to protect Information, which comply with all applicable laws.  Employees who violate our Privacy Policy are subject to disciplinary actions.

Disclosure of Information:  FBS may disclose Information to others when the Firm believes it is necessary for the conduct of its business, or where the law or regulation requires disclosure.  For example, Information may be disclosed for audit or research purposes to attorneys or other professionals, or to law enforcement and regulatory agencies to help prevent fraud.  It is FBS policy to require all third parties that are to receive any Information about a client to sign strictly enforceable confidentiality agreements.

Former Clients:  Even if no longer a client of FBS, the Privacy Policy will continue to apply with respect to Information about you.

Access to and Correction of Information:  If you desire to review any Information the Firm may maintain that includes personal Information, please contact FBS.  If you notify FBS that any Information is incorrect, FBS will review your request to correct the information.  If FBS agrees that the information should be corrected, it will correct its records.  Information collected in connection with, or in anticipation of, any claim or legal proceeding will not be made available.

Further Information:  FBS reserves the right to change this Privacy Policy.  The examples included within this Privacy Policy are illustrations only and not intended to be exclusive or fully inclusive.  This Notice complies with certain laws and regulations regarding privacy.  You may have additional rights under other jurisdiction laws that may apply within the jurisdiction of Bermuda.
